II. General terms and conditions of use

The subject of these conditions: the Website

The purpose of these General Terms of Use (hereinafter, the “Terms”) is to regulate access to and use of the Website. For the purposes of these Terms, the “Website” means the external appearance of the screen interfaces, both static and dynamic (that is, the navigation structure), and all the elements integrated into the screen interfaces and the navigation structure (hereinafter, the “Content”), as well as all online services or resources that may be offered to Users (hereinafter, the “Services”).

Global Vibes Oviedo reserves the right to modify, at any time and without prior notice, the presentation and configuration of the Website and of the Content and Services incorporated in it. The User acknowledges and accepts that the Association may at any time interrupt, deactivate or cancel any of these elements or access to them.

Access to the Website is free of charge, except for the cost of the connection through the telecommunications network supplied by the access provider contracted by the User.

The use of some Content or Services may require prior subscription or registration by the User.

The User

Access to, browsing on and use of the Website, including any spaces enabled for interaction between Users or between Users and Global Vibes Oviedo (such as comments or blog posts), confers the status of User. Therefore, by accessing the Website, the User accepts these Terms, as well as any later versions of them, without prejudice to the application of mandatory legal provisions where relevant. Users are advised to read these Terms each time they visit the Website.

The Website provides a wide variety of information, services and data. The User assumes responsibility for making proper use of the Website. This responsibility extends to:

• Using the information, Content and/or Services offered by Global Vibes Oviedo in a manner that is not contrary to these Terms, the law, morality or public order, and that does not infringe the rights of third parties or impair the normal functioning of the Website.
• The truthfulness and lawfulness of the information provided by the User in any forms made available by Global Vibes Oviedo for access to certain Content or Services. The User will immediately notify the Association of any fact that could allow the misuse of information registered in such forms — such as, but not limited to, the theft or loss of, or unauthorised access to, identifiers and/or passwords — so that they can be cancelled immediately.

Global Vibes Oviedo reserves the right to remove any comments or contributions that are unlawful or contrary to human dignity, that are discriminatory, xenophobic, racist or pornographic, that constitute spam, that endanger young people or children, public order or safety, or that, in its opinion, are not suitable for publication. Global Vibes Oviedo is not responsible for the opinions expressed by Users through comments or other participation tools.

Mere access to the Website does not create any kind of commercial relationship between Global Vibes Oviedo and the User.

The Website and the Association’s activities are intended for adults. In line with our Privacy Policy, persons under the age of 18 should not submit personal data through the Website.

The Website is aimed primarily at Users residing in Spain. Global Vibes Oviedo does not guarantee that the Website complies, in whole or in part, with the laws of other countries. Users who access the Website from other territories do so at their own risk and are responsible for ensuring that such access and browsing comply with the laws applicable to them.

III. Access and navigation: exclusion of warranties and liability

Global Vibes Oviedo does not guarantee the continuity, availability or usefulness of the Website, the Content or the Services. It will do everything reasonably possible to ensure the proper functioning of the Website, but it does not warrant that access will be uninterrupted or error-free.

Nor does it warrant that the content or software accessible through the Website is free of errors or incapable of causing damage to the User’s computer system (software and hardware). The Association will not be liable for loss or damage of any kind arising from access to, browsing on or use of the Website — including, but not limited to, damage to computer systems or damage caused by the introduction of viruses — except where such liability cannot be excluded under mandatory law.

Global Vibes Oviedo is likewise not responsible for damage that may be caused by improper use of the Website, nor for failures, interruptions or defects in telecommunications.

IV. Data protection and cookies

Personal data provided through the Website (for example, via the “Join Us” form or by email) is processed in accordance with our Privacy Policy https://globalvibesoviedo.com/privacy-policy/, which the User should read before submitting any data. V. Linking policy

The Website may provide Users with linking tools (such as links, banners or buttons), directories and search engines that allow Users to access websites owned and/or managed by third parties.

Global Vibes Oviedo does not offer or market, either directly or through third parties, the products and/or services available on the linked sites, and does not guarantee their technical availability, accuracy, truthfulness, validity or legality. It does not review or control the content of other websites, nor does it approve, examine or endorse the products, services, content, files or any other material on those linked sites, and it assumes no responsibility for any damage that may arise from accessing or using them.

Any User or third party who creates a hyperlink from another website to this Website should be aware that:

• The reproduction, in whole or in part, of any Content and/or Services of the Website is not permitted without the express authorisation of Global Vibes Oviedo.
• No false, inaccurate or incorrect statements about the Website, Global Vibes Oviedo, or its Content and/or Services are permitted.
• Except for the hyperlink itself, the website on which the hyperlink is placed shall not contain any element of this Website that is protected as intellectual property under Spanish law, unless expressly authorised by Global Vibes Oviedo.

VI. Intellectual and industrial property

Global Vibes Oviedo, whether in its own right or as an assignee, holds the intellectual and industrial property rights over the Website and the elements contained in it (including, by way of example, images, sound, audio, video, software, texts, trademarks, logos, colour combinations, structure and design, the selection of materials used, and the computer programs necessary for its operation, access and use). These works are protected as intellectual property under Spanish law, European Union law and the international treaties on the subject signed by Spain.

All rights reserved. In accordance with the Spanish Intellectual Property Law, the reproduction, distribution and public communication — including the making available — of all or part of the content of this Website for commercial purposes, on any medium and by any technical means, without the authorisation of Global Vibes Oviedo, is expressly prohibited.

The User agrees to respect the intellectual and industrial property rights of Global Vibes Oviedo. The User may view the elements of the Website and may print, copy and store them on a computer or other physical medium, provided that this is solely and exclusively for personal use. The User may not remove, alter or manipulate any protection device or security system installed on the Website.

Any trademarks, logos or images belonging to third parties that may appear on the Website are the property of their respective owners.

If a User or a third party considers that any Content on the Website infringes intellectual property rights, they should notify Global Vibes Oviedo immediately using the contact details set out in the General Information section of this Legal Notice.

VII. Legal actions, applicable law and jurisdiction

Global Vibes Oviedo reserves the right to bring any civil or criminal actions it considers necessary in the event of improper use of the Website or its Content, or of a breach of these Terms.

The relationship between the User and Global Vibes Oviedo is governed by the legislation in force in Spain and by directly applicable European Union law. Any dispute arising in connection with the interpretation and/or application of these Terms will be submitted to the Courts and Tribunals of the city of Oviedo, unless the User acts as a consumer, in which case any mandatory rules establishing jurisdiction at the consumer’s place of residence will apply.

II. Condiciones generales de uso

Objeto de estas condiciones: la Web

El objeto de las presentes Condiciones Generales de Uso (en adelante, las “Condiciones”) es regular el acceso y el uso de la Web. A efectos de estas Condiciones, se entenderá por “Web” la apariencia externa de las interfaces de pantalla, tanto de forma estática como dinámica (es decir, la estructura de navegación), y todos los elementos integrados en las interfaces de pantalla y en la estructura de navegación (en adelante, los “Contenidos”), así como todos los servicios o recursos en línea que se ofrezcan a los Usuarios (en adelante, los “Servicios”).

Global Vibes Oviedo se reserva el derecho a modificar, en cualquier momento y sin previo aviso, la presentación y configuración de la Web y de los Contenidos y Servicios incorporados en ella. El Usuario reconoce y acepta que la Asociación podrá en cualquier momento interrumpir, desactivar o cancelar cualquiera de estos elementos o el acceso a los mismos.

El acceso a la Web es gratuito, salvo por el coste de la conexión a través de la red de telecomunicaciones suministrada por el proveedor de acceso contratado por el Usuario.

El uso de algunos Contenidos o Servicios puede requerir la previa suscripción o registro del Usuario.

El Usuario

El acceso, la navegación y el uso de la Web, incluidos los espacios habilitados para la interacción entre Usuarios o entre el Usuario y Global Vibes Oviedo (como comentarios o entradas de blog), confieren la condición de Usuario. Por ello, al acceder a la Web, el Usuario acepta estas Condiciones, así como sus posteriores versiones, sin perjuicio de la aplicación de las disposiciones legales imperativas que correspondan. Se recomienda al Usuario leer estas Condiciones cada vez que visite la Web.

La Web ofrece una gran variedad de información, servicios y datos. El Usuario asume la responsabilidad de hacer un uso adecuado de la Web. Esta responsabilidad se extiende a:

• Utilizar la información, los Contenidos y/o los Servicios ofrecidos por Global Vibes Oviedo de forma que no sea contraria a estas Condiciones, a la ley, a la moral o al orden público, y que no lesione los derechos de terceros ni perjudique el normal funcionamiento de la Web.
• La veracidad y licitud de la información facilitada por el Usuario en los formularios puestos a disposición por Global Vibes Oviedo para acceder a determinados Contenidos o Servicios. El Usuario notificará de inmediato a la Asociación cualquier hecho que permita el uso indebido de la información registrada en dichos formularios —como, entre otros, el robo, la pérdida o el acceso no autorizado a identificadores y/o contraseñas— con el fin de proceder a su inmediata cancelación.

Global Vibes Oviedo se reserva el derecho a retirar los comentarios o contribuciones que sean ilícitos o contrarios a la dignidad humana, que resulten discriminatorios, xenófobos, racistas o pornográficos, que constituyan spam, que atenten contra la juventud o la infancia, el orden o la seguridad públicos, o que, a su juicio, no resulten adecuados para su publicación. Global Vibes Oviedo no se responsabiliza de las opiniones expresadas por los Usuarios a través de comentarios u otras herramientas de participación.

El mero acceso a la Web no implica el establecimiento de ningún tipo de relación comercial entre Global Vibes Oviedo y el Usuario.

La Web y las actividades de la Asociación están dirigidas a personas adultas. En coherencia con nuestra Política de Privacidad, los menores de 18 años no deben facilitar datos personales a través de la Web.

La Web está dirigida principalmente a Usuarios residentes en España. Global Vibes Oviedo no garantiza que la Web cumpla, total o parcialmente, con la legislación de otros países. Los Usuarios que accedan a la Web desde otros territorios lo hacen bajo su propia responsabilidad y deben asegurarse de que dicho acceso y navegación cumplen la legislación que les resulte aplicable.

III. Acceso y navegación: exclusión de garantías y responsabilidad

Global Vibes Oviedo no garantiza la continuidad, disponibilidad ni utilidad de la Web, de los Contenidos o de los Servicios. Hará todo lo razonablemente posible para asegurar el correcto funcionamiento de la Web, pero no garantiza que el acceso sea ininterrumpido ni esté libre de errores.

Tampoco garantiza que el contenido o el software accesible a través de la Web esté libre de errores ni que no pueda causar daños en el sistema informático del Usuario (software y hardware). La Asociación no será responsable de las pérdidas o daños de cualquier tipo derivados del acceso, la navegación o el uso de la Web —incluidos, entre otros, los daños en sistemas informáticos o los causados por la introducción de virus—, salvo cuando dicha responsabilidad no pueda excluirse conforme a la normativa imperativa.

Global Vibes Oviedo tampoco es responsable de los daños que puedan derivarse de un uso indebido de la Web, ni de los fallos, interrupciones o defectos en las telecomunicaciones.

VII. Acciones legales, legislación aplicable y jurisdicción

Global Vibes Oviedo se reserva el derecho a ejercitar las acciones civiles o penales que considere necesarias por el uso indebido de la Web o de sus Contenidos, o por el incumplimiento de estas Condiciones.

La relación entre el Usuario y Global Vibes Oviedo se regirá por la legislación vigente en España y por la normativa de la Unión Europea directamente aplicable. Cualquier controversia derivada de la interpretación y/o aplicación de estas Condiciones se someterá a los Juzgados y Tribunales de la ciudad de Oviedo, salvo que el Usuario actúe como consumidor, en cuyo caso se aplicarán las normas imperativas que establezcan la jurisdicción en el lugar de residencia del consumidor.
